Terms of Service

§1 Acceptance of Terms

By accessing or using evbreakeven.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site. These Terms form a binding contract between you and Indraprastha Publications ("we," "us," "our").

§2 Eligibility

You must be at least 18 years old to use the Site. By using the Site you represent that you have the legal capacity to enter into these Terms in your jurisdiction.

§3 The Service

The Site provides free EV cost calculators, state and federal incentive information, vehicle data, and editorial content. Calculators produce estimates. Incentive amounts and eligibility rules change frequently. Vehicle MSRPs and specifications change with model years.

§4 No Professional Advice

Nothing on the Site constitutes financial, tax, legal, or other professional advice. Calculator outputs are informational estimates, not commitments by us, by any vehicle manufacturer, or by any government agency. Tax credit eligibility is determined by the U.S. Internal Revenue Service, not by us. Decisions about EV purchases, tax credit claims, or charging-equipment investments should be made in consultation with qualified professionals in your jurisdiction. See our disclaimer.

§5 Acceptable Use

You agree not to:

• Use the Site in any way that violates applicable law.
• Scrape, crawl, or systematically extract content except as permitted by our robots.txt and llms.txt.
• Attempt to gain unauthorized access to any portion of the Site or any related systems.
• Introduce malware, viruses, or any code intended to damage the Site or its users.
• Reverse-engineer or attempt to derive the source code of the Site beyond what is publicly served.
• Misrepresent your affiliation with any person or entity.
• Use the Site to harass, abuse, or harm any other person.

§6 Intellectual Property

The Site, its design, code, calculator methodology, editorial prose, and compilation of incentive data are owned by Indraprastha and are protected by copyright, trademark, and other intellectual-property laws. Calculator methodology and factual incentive data are licensed under CC-BY-4.0 with attribution; editorial prose is not licensed for verbatim reproduction without permission. Vehicle names, logos, and trademarks belong to their respective owners and are referenced for identification purposes only.

§7 Third-Party Links and Content

The Site links to third-party sites including IRS.gov, EIA, fueleconomy.gov, DSIRE, vehicle manufacturers, and state energy offices. We do not control these sites and are not responsible for their content, privacy practices, or terms.

§8 Advertising

The Site is supported by advertising (Google AdSense). Ad content is provided by third-party advertisers and is not endorsed by us. Your interactions with advertisers are between you and the advertiser.

§9 No Warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of data, and availability. We do not warrant that calculator outputs are accurate for your specific situation, that incentive amounts shown are current, or that the Site will be uninterrupted or error-free.

§10 Limitation of Liability

To the fullest extent permitted by applicable law, our total aggregate liability to you for any claim arising from or related to the Site is limited to ₹1,000 (one thousand Indian rupees) or the equivalent in your local currency at the prevailing exchange rate. This cap applies regardless of the legal theory (contract, tort, statute, or otherwise). We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or lost opportunity, even if we have been advised of the possibility of such damages.

§11 Indemnification

You agree to indemnify, defend, and hold harmless Indraprastha, its directors, officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

§12 Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

§13 Arbitration; Class Action Waiver

Any dispute arising from or relating to these Terms or the Site that cannot be resolved through informal discussion shall be resolved by binding arbitration administered in Hyderabad, Telangana, India, under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English by a single arbitrator. The arbitrator's decision shall be final and binding.

Class action waiver: You agree that disputes shall be brought only in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative or class proceeding.

The exclusive venue for any matter not subject to arbitration (including injunctive relief to protect intellectual property) is the courts of Hyderabad, Telangana, India.

§14 Termination

We may suspend or terminate your access to the Site at any time, with or without cause, with or without notice. Sections that by their nature should survive termination — including §6 (IP), §9 (no warranties), §10 (liability), §11 (indemnification), §12 (governing law), §13 (arbitration), and §14 — shall survive.

§15 Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be highlighted via a banner on the Site for a reasonable period. Continued use of the Site after changes constitutes acceptance.

§16 Severability; Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and any additional terms posted on specific pages, constitute the entire agreement between you and us regarding the Site.
